$65 Million Awarded in Fatal Trucking Crash Case in Colorado
A Colorado jury awarded $65 million on Tuesday to a 14-year-old boy following the death of his mother in a trucking accident on August 8, 2022, on Interstate 25.
According to Dulin McQuinn Young, LLP, the case involved truck driver Darnell Yingling and his employer, Import Auto Inc., also known as Import Towing and Recovery. The trial lasted five days, culminating in a verdict that the jury's findings reflect the serious nature of the crash, which resulted in the death of 32-year-old Megan Arneson.
Authorities stated that Arneson and her then-10-year-old son were driving home from a water park when Yingling's improperly loaded excavator struck a bridge. Investigators with the Colorado State Patrol determined that the load exceeded the clearance beneath the overpass, leading to the incident. Concrete debris fell onto I-25, and a large piece struck Arneson in the head, resulting in her death at the scene.
The lawsuit claimed negligence by both Yingling and Import Auto Inc. for failing to secure the load properly, as well as inadequate training and inspection protocols.
This verdict marks the largest jury award for a trucking accident in Colorado, according to the law firm. Attorney Kari Jones Dulin, lead counsel for the boy, emphasized that the outcome serves as a message about the importance of safety in the trucking industry.
The case has raised significant awareness regarding trucking regulations as families seek to promote safer practices on the roads. Authorities continue to monitor trucking industry compliance to prevent similar tragedies in the future.
