TULSA, Okla. (WKRC) – An Oklahoma man has been sentenced to five years in prison following a crash that killed his 16-year-old daughter on January 11, 2024.

Elliott Binney, 41, was also ordered to serve five years of probation after pleading guilty to first-degree manslaughter, leaving the scene of a fatal accident, transporting an open container, and two counts of child neglect. Binney entered the plea in April.

According to authorities, Binney lost control of an carrying multiple juvenile passengers, resulting in the vehicle rolling over several times. His daughter, Shelby Binney, was during the incident and later succumbed to her injuries.

Witnesses reported the vehicle was traveling at a high rate of speed in rainy conditions prior to the crash, overtaking other cars in a no-passing zone. An open bottle of vodka was located near the wreckage, and Binney admitted to consuming alcohol while driving.

After the crash, he fled the scene on foot but was apprehended approximately 40 miles away in Checotah. Prosecutors stated there was insufficient evidence to show he was legally impaired during the incident.

Tulsa County District Attorney Steve Kunzweiler emphasized that Binney's actions after the crash significantly impacted the sentencing decision.
