PHOENIX (TNND) — A 30-year-old woman was arrested following a crash on April 12 that killed her 9-year-old daughter and injured three other children, including a baby, according to U.S. Immigration and Customs Enforcement ().

Authorities identified the suspect as Brenda Liliana Rivera-Estrada, who faces charges of manslaughter and child abuse. Witnesses reported that Rivera-Estrada appeared to be impaired during the incident.

Rivera-Estrada was initially booked on the charges and held on a $100,000 bond. However, ICE stated that the county attorney did not file criminal charges, allowing her to be released before federal immigration officials took custody.

Maricopa County Attorney Rachel Mitchell clarified in a social media post that her office did not decline to prosecute, but rather sought further investigation, including DUI lab results and collision analysis.

ICE confirmed that Rivera-Estrada entered the U.S. through Nogales in February 2009 with a temporary authorization that expired 30 days later, and she has since remained in the U.S. unlawfully.

She is currently in ICE custody pending immigration proceedings.
